Borrower Defense to Repayment Regulations - Where Do Things Stand?

The federal Borrower Defense to Repayment (BDR) regulations have been the subject of significant development over the past few years. Regulations were finalized in 2016 only to be placed on hold. New regulations were proposed in 2018 but have not yet been finalized. In the meantime, a federal court ordered the Department to enforce the first set of regulations. Attorney Christopher DeLuca, a member of both the 2016 and 2018 BDR federal negotiated rulemaking committee, will help explain where things stand and what schools might expect with respect to BDR.
